It was 3:44 on Saturday morning, and a San Jose State student was walking across campus with two friends. According to the Santa Clara County District Attorney's Office, as reported by KTVU and NBC Bay Area, two men asked him if he was gay and yelled anti-gay slurs. He and his friends ignored them and kept walking.
Prosecutors say the two men then ran up and attacked him, punching him in the head more than two dozen times and kicking him, still shouting slurs. One of his friends jumped on him to shield him and was struck too. He was taken to a hospital and later released. University police arrested both men before they left campus, and campus cameras caught it, NBC Bay Area reports.
Josue Medina Flores, 19, of Sunnyvale, and Christian Gabriel Nunez Petty, 20, of Fremont, are charged with felony assault with hate crime allegations. They were due to be arraigned Wednesday afternoon at the Hall of Justice in San Jose. They are presumed innocent, and the charges are allegations.
"If you hurt someone because of their race, religion, gender, or sexuality, you will be arrested and prosecuted," District Attorney Jeff Rosen said.
The student has not been named, and should not be. The friend who put her body between him and two men has not been named either. She is the best person in this story.
